1. Our Contract
These Terms and Conditions govern the supply of goods sold by Total Site Safety Limited, Unit 29, Bury Business Centre, Kay St, Bury, Greater Manchester, BL9 6BU. The terms (“we” and “us”) refer to us the seller and the term (“you”) refers to you the customer – these constitute the entire and only agreement between us in relation thereto. All orders placed are subject to acceptance by delivery of the goods to you at which point a legally binding contract is constituted between us on these Terms and Conditions.

2. Prices & Payment
2.1 The price payable for the goods you order is as set out on our web site totalsitesafety.co.uk at the time you place your order, plus any charges for shipping and delivery as set out in the order form. We reserve the right to change the price of goods, due to market conditions, but we will confirm the prevailing price with you before accepting your order. We are not obliged to accept your order for such goods and may decline it or limit the order quantity.
2.2 Unless otherwise stated in writing, all charges specified shall be exclusive of value added tax (“VAT”) if the item is vatable, which shall be due at the rate ruling on the date of the VAT invoice.
2.3 Occasionally an error may occur with our system and goods may be incorrectly under priced, in which circumstances we will not be obliged to supply the goods at the incorrect price.
2.4 Subject to clause 2.5, if you are not a Trade Customer, we must receive payment for the whole of the price of the goods you order, and any applicable charges for carriage and insurance, before your order can be accepted, unless we have agreed otherwise in advance in writing.
2.5 If you are a Trade account customer, payment shall be made in full at the end of the month following the date of invoice. We may revoke credit if you fail to make payment when due. If payment is not made when due, interest is payable at the rate of 3 per cent over the current base rate on the amount outstanding from the due date for payment until receipt by us of the full amount (including any accrued interest whether before or after judgment, together with any reasonable legal or other recovery costs.
2.6 Any client that requires a credit account will automatically be credit checked by us.
2.7 All goods will remain the property of Total Site Safety Ltd until paid for in full.
3. Delivery
FREE delivery is offered on orders over £200 net. We will deliver goods in accordance with your order. We will use the services of Royal mail, UK Mail and Fedex depending on the size of your order. A valid signature will be required upon collection or delivery. Upon delivery of the goods to you, the goods shall be at your risk. All goods should be checked upon delivery, and we require any discrepancies to be reported within 24 hours.
All timed deliveries are a guide only and we are not responsible for third party execution of any of these services,
4. Availability
Whilst we endeavour to hold sufficient stock to meet all orders, if we have insufficient stock to supply or deliver the goods ordered and paid for by you, we may, at our discretion, supply or deliver a substituted equivalent product of equal or higher value, or refund you the price paid for such goods. If you require a specific brand then it is critical that you request this in writing and we will do our best to supply as requested.
5. Cancellations & Returns
All refunds will be subject to our terms and conditions. Your refund will be issued to the payment method used to pay originally for the item. Should a refund be required to a credit card, the customer shall provide the card number to us again so we can process the refund to the same card. Card details are never kept on file after payment has been processed, and refunds shall be issued in accordance with statutory requirements.
Once a refund is issued from us, please allow approximately 10 working days for the refund to reach your account. This timeframe is dictated by your bank or card issuer and is outside of our control.
If after 28 working days of returning your item you have not been refunded, please contact us on our Contact Us page.
If any items are returned to us for reasons such as not being able to deliver, the customer has moved, not being around to accept delivery, or there are faulty, damaged or exchanged items, we will try and find an alternative address by whatever means possible within reason. Should this prove unsuccessful, we will keep the goods for a maximum of 6 months and then will recycle or dispose of as we see fit. Any Items returned without prior authorisation via the returns procedure will be treated the same way.
We will accept items for return within 7 days from the goods are delivered, providing the goods are still in the original packaging, goods are in re-sellable condition and the goods are not printed or embroidered.
It is the customer’s responsibility to cover the cost of returning items that are not faulty, damaged or incorrect. A re-stocking charge of 25% maybe charged if no replacements are required, and the item is a non-stocked item.
If you would like to return any items you have ordered then please download our returns form, fill it in and enclose with the returned goods. We would advise Royal Mail recorded delivery service or proof of postage. We recommend this, because if items get lost in the normal post, we regret that we are not responsible for any items not received here. Using a trackable method protects you if your items get lost in the post, by enabling you to claim from your chosen delivery company.

Please note, we will not issue any refunds for items not returned to us.
6. Liability
If you have notified us of a problem with the goods within 7 days of delivery, we will (subject to clause 4) either rectify any shortage or non-delivery; replace/repair any goods that are damaged or defective upon delivery. We will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods, or delivery timescale, and we shall have no liability to pay any money to you by way of compensation, other than any refund we make under these conditions. This does not affect your statutory rights if you are a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence.
7. Limited Companies & Trade Accounts
Those signing the Trade Credit Account Application Form on behalf of limited companies do so as guarantor and undertake to guarantee the payment of all monies owing to us by the relevant limited company if we believe that the limited company cannot meet its obligations. If the limited company goes into receivership, liquidation or administration the guarantor will pay to the receiver, liquidator or administrator, as the case may be, such sum as will enable him to pay all monies owed to us by the limited company.
8. Termination of Contract
We reserve the right to suspend further supply or delivery, stop any goods in transit or terminate our contract by notice in writing to you if you are in breach of an obligation hereunder or you become unable to pay your debts when they fall due or proceedings are commenced by or against you alleging bankruptcy or insolvency. Upon termination, your indebtedness to us becomes immediately due and payable and we shall be under no further obligation to supply goods to you.
9. Force Majeure
We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).
